A new governance for the European space infrastructures

In entrusting the Union with the duty to “establish a European space policy” and, in order to do that, to establish “any useful link with the European Space Agency”, art. 189 of the Lisbon Treaty leads to a global redefining of the competences and responsibilities of the three main EU institutions in the working out, the financing, the steering and the control of this new common policy as well as a part or global redefinition of ESA status and role, destined to keep on playing, for reasons of technological and industrial expertise, a key role in the management of programmes. Which governance for public and commercial exploitation of Galileo? GMES? Which rules of responsibility, confidentiality, etc in the relationship between the European authorities and their industrial partners?

From a straight supply policy to a genuine industrial policy

ESA has heavily contributed to the preservation of the current positions of the European space stakeholders thanks to a supply policy of public programmes resting on the practice of “fair return”. The perspective of an evolution of ESA’s status and role as well as a revision of this formula of markets allocation as well as other requirements such as the need to guarantee a sufficient autonomy in the mastering of the R&D of technologies leading to industrial applications and high added value services beyond the strict space sector activity or else the chances of overcapacities in a couple of industrial segments at a time where competition from non European industries strongly supported by public authorities is on the increase, all those factors pose, with gravity and urgency, the question of the type of industrial policy to be conducted by the EU. As regard also the competition regulations, public markets directives and the principle of “Community preference”.

Financing: public credits, private investments, commercial space

The control of public financing imposed by the economic crisis, could not spare a European space sector owing to public ordering, both national and European, the very good position it holds today at a world level. To the relevance of the choice by officials in charge of space programmes in the allocation of public credits must now be added a creative financial engineering capable of mobilizing private capital to the benefit of these space programmes as well as political and regulatory stimulants, in favour of the development of commercial applications ( telecoms, TV broadcasting, etc.) as well as non commercial ones ( meteorology, air traffic management) enabling the contribution of external financing.

State of play of the main European space programmes

Before the end of 2010, a first Galileo satellite should be orbited. The Commission and ESA could also have allocated all or part of the last satellites to be put on work. All other chapters, support and system engineering, mission, control, launching of constellation, are being readied. Regarding GMES, the Commission must work out, with the assistance of the GMES partners Council , a strategic implementation framework, including an indicative and multi annual planning of its activities, a cost appraisal of GMES’ activities, a preliminary budget strategy and participation rules to the programme

Space infrastructures to the service of crisis management, security and defence

The Galileo system, via its Public Regulated Service or PRS, and its two urgency services will be used for security purposes. Likewise the accuracy of the positioning data will be an efficient tool for armed forces and security. The GMES infrastructure, via the integration of the global ground installations and satellites, existing or projected, will also be a priceless tool for the accurate data it will allow to collect over numerous factors linked to security: maritime surveillance, borders control, monitoring of population forced displacements, surveillance of ground and maritime moves, etc.
